Technical Barrier, Anti-Dumping Thorny `Korea Export`

According to the MOCIE (Ministry of Commerce, Industry and Energy) and KOTRA (Korea Trade-Investment Promotion Agency) on July 12, there were 4300 TBT cases which are notified to an executive office since WTO establishment so far. Until May, 259 cases have been newly reported.

TBT is to keep through specifying the individual certification standard and technical standard for safe environment preservation of each country, but it can be a burden to for exporting countries. Especially, because advanced countries require the high technical level, it can be a weapon to protect the market advance of companies with low technical level.

ON July 12, MOCIE had `Conference for industrial technology promotion` in Plaza Hotel, Seoul under superintendence of Shin Gook-Hwan, the minister of MOCIE to discuss `TBT.

▽Sophisticated TBT 〓EU will prohibit the use of motorcar which contained a heavy metal such as a Lead, Mercury and Cadmium from July 1, 2003. Any heavy metal must not be detected in the car. EU let the companies reduce a discharge quantity of Carbon Dioxide of the motorcar to below 140g per km. Currently, the discharge of Carbon Dioxide of Korea motorcar is currently to the level of 200g per km.

US which experienced in bad tire upheaval of Firestone plans to legislate the stern technical standard newly on the tire for motorcar through strengthening the conditions of speed test and endurance test.

Kim Yun-Gwang, the manager of Basic Technology Standard, Korean Agency for Technology and Standard said ꡒThe policy which Japan schedule to execute for recycle of PC from the end of the next year is a new variety of TBTꡓ. Through this policy, the exporting companies acquire the license of waste disposal and specify the recycle agency in Japan.

The EU does not permit to use the Lead, Mercury and Cadmium to the production process of all electronic products from 2008. It is the good example of the high technology. Lee Eun-Ho, the assistant manager of International Standard, Korean Agency for Technology and Standard said ꡒEU plans to protect the market developing the tinkering technology not using the lead.

▽Increasing Anti-Dumping〓 Cases of Anti-Dumping measures jumped to 330 cases from 157 cases in 1995. There are 1840 cases for Anti-Dumping measures for 91 countries since 35 countries after organizing the WTO. Especially, there are 138 cases which Korea levied or collected the custom duty. So, Korea is the second after China.

Song Yu-Hwang, the assistant manager of Foreign Investigation Team, KOTRA said ꡒIt shows the trend that each country uses the Anti-Dumping measure as safety mean of own country`s industryꡓ.

There are a lot of Anti-Dumping measure of steel area which is the supply excess state in the world. Last year, the Anti-Dumping measures by item included △Steel & Metal: 128 cases △Chemistry: 65 cases △Rubber & Plastic: 40 cases △Machinery and Electricity: 25 cases.

As of the end of June, Korea received the import restrictions of 129 cases such as Safeguard, Anti-Dumping restraints and Subsidies & Countervailing Duty from 22 countries in the world.
